GENERAL CONDITIONS OF SALE - RUNES DE CHENE

These conditions of sale are concluded on the one hand by the company LAHOUSSAYE EI - trading name RUNES DE CHÊNE, whose head office is located in CONTES, registered in the Trade and Companies Register of NICE under the SIRET number 844256537 00011 and managing the site www.runesdechene.com and www.guildedesvoyageurs.fr and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.runesdechene.com or www.guildedesvoyageurs.fr hereinafter referred to as "the buyer".

Article 1. Purpose

These conditions of sale aim to define the contractual relations between LAHOUSSAYE EI / RUNES DE CHÊNE and the buyer and the conditions applicable to any purchase made through the website www.runesdechene.com. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale, which the buyer acknowledges having read prior to placing his order.

The company LAHOUSSAYE EI reserves the right to modify these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. As a result, the applicable conditions will be those in force on the date of the order by the buyer.

Article 2. Products

The products offered are those that appear on the website www.runesechene.com offered by the company LAHOUSSAYE EI within the limit of available stocks. The Company reserves the right to modify the product assortment at any time. Each product is presented on the website in the form of a description including its main technical characteristics. The photographs are as faithful as possible but do not bind the Seller in any way. The sale of the products presented on this site is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

Article 3. Rates

The prices listed on the product sheets of the online catalog are prices in Euros (€) including all taxes (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. The company LAHOUSSAYE EI reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased according to the total amount of the order. In mainland France, for any order greater than or equal to €100, shipping costs are free; for any order less than €100 including tax, a flat rate contribution to shipping costs will be invoiced to the buyer in an amount, calculated at the time of checkout.

Article 4. Order and payment terms

Before any order, the buyer is free to create or not an account on the site www.runesdechene.com. The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wishes to order or consult his account (order status, profile, etc.), must identify himself using this information. The Company LAHOUSSAYE EI offers the buyer to order and pay for his products in several stages, with 1 payment option:

- Secure payment by SHOP or credit card (VISA, etc.) : the buyer selects the products he wishes to order in the "basket", modifies if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of his choice: SHOP by Shopify or a credit card system such as VISA or MASTERCARD. The next step asks him to check all the information, read and accept these general terms and conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the secure interface in order to securely enter his personal credit card details. If the payment is accepted, the order is registered and the contract definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use of the card, the buyer may demand cancellation of the card payment, the amounts paid will then be re-credited or refunded. The liability of the holder of a bank card is not incurred if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of his card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must contest, in writing, the direct debit with his bank, within 70 days following the transaction, or even 120 days if the contract binding him to it provides for it. The amounts withdrawn are reimbursed by the bank within a maximum of one month after receipt of the written dispute filed by the cardholder. No costs of restitution of the sums may be charged to the cardholder.

Note 1: Paypal has been removed from the payment methods due to the platform's fraudulent calculations and unreachable support. Runes de Chêne is therefore boycotting the PAYPAL platform until further notice.

Note 2: The study of accepting payments in the form of cryptocurrency is under consideration.

Confirmation of an order implies acceptance of these conditions of sale, recognition of having full knowledge of them and the waiver of the right to rely on one's own conditions of purchase. All data provided and the recorded confirmation will constitute proof of the transaction. If the buyer has an email address and has provided it on their order form, the company LAHOUSSAYE EI will send them confirmation of the registration of their order by email.

Article 5. Reservation of ownership

The company LAHOUSSAYE EI retains full ownership of the products sold until full payment of the price, including principal, costs and taxes.

Article 6. Withdrawal

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, with the exception of return costs.

However, this period is only applicable for online sales made remotely.

Orders placed on stand cannot be returned or exchanged. A spontaneous exception may be made by the seller, if the customer indicates his desire for an exchange the same day or the following day, provided that the stand is still set up.

Orders placed on demand at terminals can be modified within 48 hours, but are neither returned nor exchanged, as they were made on the stand and are a personalized product.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. Orders are made by a delivery service with or without tracking, with or without delivery with signature. Delivery times are given for information purposes only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed unless the buyer has been previously notified digitally or it is an item that indicated a long shipping period. The company LAHOUSSAYE EI may provide the buyer by e-mail with the tracking number of their package if the shipment has one. The buyer is delivered to their home by their postman. In the absence of the buyer, they will receive a delivery notice from their postman, which allows them to collect the products ordered from the nearest post office, during a period indicated by the postal services. The risks related to transport are the responsibility of the purchaser from the moment the items leave the premises of the company LAHOUSSAYE EI. The purchaser is required to check in the presence of the postal worker or the delivery person, the condition of the packaging of the goods and its contents upon delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 8. Warranty

All products supplied by the company LAHOUSSAYE EI benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned to the Seller who will take it back, exchange it or refund it. All complaints, requests for exchange or refund must be made digitally to contact@runesdechene.com, within 14 days after delivery.

Article 9. Liability

The company LAHOUSSAYE EI in the process of distance selling, is only bound by an obligation of means. Its liability cannot be incurred for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.

Article 10. Intellectual Property

All elements of the site www.runesdechene.com and www.guildedesvoyageurs.fr are and remain the intellectual and exclusive property of the company LAHOUSSAYE EI. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text, unless the agreement was given in writing or electronically.

Article 11. Personal data

The company LAHOUSSAYE EI undertakes to preserve the confidentiality of the information provided by the buyer, which he would be required to transmit for the use of certain services. Any information concerning him is subject to the provisions of law n° 78-17 of January 6, 1978. As such, the Internet user has a right to access, modify and delete information concerning him. Article 12. Dispute Resolution

These conditions of distance selling are subject to French law. For any disputes or litigation, it is up to the Buyer to contact the Seller to find an amicable solution, and in which case it would be impossible, the Buyer or the Seller is free to initiate proceedings before a Court subject to French law.
